Elon Musk’s X has filed a petition against the Government of India in the Karnataka High Court. It states that the officers of the Government of India are blocking content on X, which is a misuse of Section 79(3)(B) of the IT Act.
According to media reports, the petition states that this method of censorship is completely illegal and a violation of the right to expression. Information about when this petition was filed is not known.
The social media company says that if the content starts getting removed so easily, they will lose the trust of the users, which will affect the company’s business.
The government is removing content through the cooperation portal
Elon Musk’s X Corp alleged that the government blocks content through a portal called ‘Sahyog’. The Indian Cyber Crime Coordination Center operates this portal. Police and government departments order the removal of content at the behest of the Home Ministry.
X claims that government officials in India are bypassing proper legal processes and setting up an illegal system to block online content. X has said that the Sahyog portal is working like a ‘censorship portal’, so it cannot be considered a step taken as per the rules.
Pressure on X to appoint a nodal officer
Elon Musk’s X said that the Supreme Court has also approved Section 69 (A). Whereas there is no transparency in the Sahyog portal. X Corp said that thousands of officers are giving orders without any rules. There is also pressure to appoint the company as a nodal officer.
X said in the petition that no law compels the company to join the Sahyog portal. The company says that they have already recruited the necessary officers under the IT rules, so they do not need to recruit separate officers for the ‘Sahyog Portal’.
According to reports, the first hearing of this case was held recently. The government told the court that no action has been taken against X Corp. The court assured X that if any strict action has been taken by the government without following the rules, then inform them.
